REGULATIONS OF THE STAY AT THE LA GUITARRA HOSTELS

I. DEFINITIONS.

  1. Mixed Dorm – a bed/place in a mixed shared room. The next places in this room can be taken as influx of reservations according to the reception decisions on seting arrangements in rooms. In rooms of this type Guests can recon with a possibility of sharing a room with other unfamiliar persons of both sexes. One reserved bed in a room of this type is intended exclusively for one person.
  2. Private Room – a private room which is rented in its entirety by one person or by a few persons.
  3. Provisional booking – it is a booking without a guarantee of the Hostel as for the price, quantity and type of places/rooms and length of a stay.
  4. Reservation confirmed in writing (guaranteed) – it is a reservation guaranteed by making the down payment or by data of a credit card. A guarantee is applying to the price of stay, length of stay as well as the quantity and types of places or rooms.
  5. Group reservation – a reservation that is made by one entity/person for at least 10 places in the same time.
  6. Individual booking – a booking made by one natural person for less than 10 places in the same time.
  7. Reservation without a possibility to a refund – (non-returnable, guaranteed) – a reservation confirmed in writing. In case of this reservation, the whole payment for a stay is being taken on a day of reservation. The payment is not subject to a refund.
  8. Down payment/Advance payment – non-returnable payment on a guaranteed reservation.
  9. Credit card – the data of a credit card are made by the Guest available to secure all the payments associated with the stay.
  10. Written confirmation of a booking – a written statement of the Hostel in the form of an e-mail that is issued after making the down payment or sending the data of a credit card. In case of group reservations it is also possible another actual confirmation of taking out the obligating title (the order) by the Guests.
  11. Reservation inquiry – an inquiry about a possibility of making an overnight stay reservation at the Hostel.
  12. An e-mail address, which was given by a person or the Hostel, is a binding address in the declaration of intent range in the object of the reservation.
  13. One can also make a reservation at the Hostel reception.

II. GUEST SERVICE RULES.

  1. The Hostel reception is open 24 hours a day.
  2. Beds in rooms or entire rooms are being rented for hostel days.
  3. A hostel day starts at 2 pm on the day of renting. We wait for guests at any time. A room or a bed will be at Guests’ disposal as early as possible. Please take into consideration the fact that they require earlier preparations as well as Guests taking up rooms the previous day should check out.
  4. Check-out – a hostel day is drawing to an end at 11 am. By this time a Guest should vacate a room (place) and give back a key to the Hostel reception. Not check-out up to 11 am results in calculating a payment for the next hotel day begun but it does not constitute a guarantee of extension the stay.
  5. In case of a room or bed will not be vacated up to 11 am and a room or a bed is booked for the next hotel day by another Guest, the Hostel staff is eligible for entry into the room without a Guest’s presence to pack their things and move them into the left luggage office.
  6. A Hostel Guest should make a request for an extension of the stay up to 6 pm of a day that precedes a day in which the time of the stay is expiring.
  7. The Hostel takes into consideration requests for an extension of a stay as it has vacancies. A request for an extension of a stay does not constitute a guarantee of recognizing a reservation as confirmed.
  8. Both beds and rooms are rented for specific Guests. Each of the Guests can be asked for showing proof of identity when checking in.
  9. Lending rooms or beds in rooms to other persons or Guests is unacceptable and it is at variance with the Regulations even if a Guest paid the due charge for a period of the stay and the period did not expire.
  10. Exclusively registered persons or minor children in their care can stay in the area of property.
  11. Persons not registered in the Hostel can stay at the area of the property from 2 pm to 10 pm exclusively with consent and knowledge of the Hostel staff. Staying persons from the outside apart from the appointed hours is forbidden.
  12. Bed time is in force from 11 pm to 6 am. During the bed time, persons using services of the Hostel have a duty to behave in the way not disrupting the peace of other Guests and both the Hostel and neighbouring properties residents.
  13. A Guest who goes out of the room should check whether the door is closed as well as should leave a key at the reception. In the event of a loss of the key a payment is being taken according to the price list which is placed on the web page www.lagitarra.com.
  14. During longer stays rooms are being cleaned after the third hostel day. The bedclothes are being changed after the seventh hostel day.
  15. The Hostel puts so-called shared parts at all the Guests disposal. We ask for keeping these places in order and cleanness. The reception hall, dining-room, kitchen, common room and computer posts are excluded from using during the bed time (11 pm – 6 am).
  16. A smoking ban is in force at the area of entire property. One can smoke in designated places only. Persons or Guests who do not follow the ban will be made to pay for according to the price list placed on the web page www.lagitarra.com. This payment constitutes the cost recovery, in particular of washing curtains, net curtains, bedspreads, fitted carpets, carpets, bedclothes and other textiles that are in a room where a smoking ban was broken. A smoking ban applies to smoking tobacco and its substitutes (e-cigarettes) as well as other stimulants.
  17. On account of the fire safety it is forbidden using various devices in rooms, in particular heaters, electric irons and other similar devices which are not equipment of a room. It does not regard battery chargers and power packs to RTV and computer devices.
  18. One cannot move rooms equipment without the reception’s consent.
  19. The Hostel may both refuse the accommodation or evict a Guest, whose behaviour could infringe or infringed the Hostel Regulations or it infringed rules of the community life, in the course of the stay. In this case, an amount due for the stay is not subject to return.
  20. A Guest bears the full material responsibility for any kind of damaging or destroying objects, equipment and technical devices that rose from the fault both of a Guest or persons visiting them. In case of becoming known of the circumstance mentioned above, the Hostel has the right to make a Guest pay for destruction or damage which are being talked in this point. In case of group booking, persons, who are provided with the booking, are jointly responsible.
  21. The Hostel is in the protection agency 24-hour care.
  22. The Hostel shared parts are 24-hour monitored.
  23. The Hostel responsibility from the title of loss or damaging, in particular money, securities and valuables or objects having scientific or artistic values, is limited if these objects will not put in safe deposit at the reception. Rooms are not intended for storage things mentioned above.
  24. Guests should inform a person at the Hostel reception of the appearance of damage immediately after they state the damage.
  25. The Hostel does not bear any responsibility for damage or loss of a car or another vehicle belonging to the Guest.
  26. Personal belongings, which were left by a leaving Guest, may be sent back to the address indicated by a Guest and at their request and expense. In case of not receiving such an instruction, the Hostel will store things for 30 days. They will be removed after the passage of this period.
  27. Keys are being collected from the Hostel reception after the bailment cash. The amount of the bail is determined in the price list which is placed on the page www.lagitarra.com. The bail is being returned when check-out at the moment a Guest is returning an undamaged key. In case of losing or destroying the key a payment is being taken according to the price list which is placed on the page www.lagitarra.com.
  28. Each registered Guest is obliged to collection of a key.
  29. The Hostel reception may forbid to go the Hostel premises or remove a person not having a key from the property. It is in frameworks of the procedure of protecting the property against staying unauthorized or undesirable persons.
  30. In case of noticing damage or failure of a device, equipment or property, a Guest should inform the Hostel reception immediately of this fact. It will enable the service immediate reaction.
  31. In case of noticing a situation that is being able to constitute the risk of the appearance of the threat to life, health, peace, bed time or loss of the Hostel residents’ possessions, a Guest should inform the Hostel reception immediately of this fact. It will enable the service immediate reaction.
  32. Guests sleeping at the Hostel in a bed without the put bedclothes will be made to pay for according to the price list which is placed on the page www.lagitarra.com . A payment covers the cost of disinfection of a quilt, a pillow and a mattress.
  33. Guests using lot of beds than rented and paid will be made to pay the amount due resulting from the actual quantity of used beds.
  34. Guests leading other persons, who are not being registered Hostel Guests, to the Hostel premises without consent of the reception will be made to pay the amount due according to the price list, which is placed on the page www.lagitarra.com.
  35. Making available the entrance card to third parties may result in cancellation the booking or the interrupt of the stay as well as the amount due according to the provisions of point 34 of this Regulations. It is due to the safety of possessions and health of other persons.
  36. Situations causing the threat to life, health and peace of the Hostel residents may be a reason to cancellation the booking or the interrupt of the stay for the request of the Hostel.
  37. The total ban is applying to the consumption in rooms on the Hostel premises. The consumption is permitted in the area of a common room in the dining-room and in relaxation parts.
  38. All food and drinks will be removed from a room by the Hostel staff.
  39. The total ban is applying to the consumption of alcoholic beverages and taking intoxicants in the entire property.
  40. All extra charges associated with the stay of the Guest are determined in the price list, which is placed on the page www.lagitarra.com and it is accepted by the Guest in one piece.
  41. All charges resulting from payments for the stay including payments listed in point 2 of this regulations can be taken within the Guarantee of a credit card and without the presence of the Guest.
  42. In case of group reservations, confirmed in writing conditions of the order are being accepted too binding if provide otherwise than this Regulations.
  43. One or a few reservations to the total number of places bigger than 10 and in the same time making by one person may be treated by the Hostel as making a group reservation. In this case the Hostel is reserving the right to the refusal of the confirmation of a reservation.
  44. In case of group reservations, confirmed in writing conditions of the order are being accepted too binding if provide otherwise than this Regulations. Giving the written consent is held in particular via e-mail.

III. BOOKING AND PAYMENT RULES

  1. One can book:
    • automatically – using online systems of booking
    • in a traditional way – through a contact with the reception: by e-mail, via internet communicators, personally at the Hostel reception, by phone and fax.
  2. Booking is considered to be guaranteed as for the price, length of stay and quantity of booked rooms/places after written confirmation of the booking by the Hostel.
  3. The Hostel confirms the booking in writing after receiving the down payment or receiving the data of a valid credit card. It is asserting that adequate rules of the civil code applied up to the down payment can be applied exclusively after sending the confirmation mentioned above rather than since the moment of the payment.
  4. The Hostel is reserving the right to the refusal of the written confirmation of a reservation in spite of the down payment or sending the data of a valid credit card.
  5. In case of arising the circumstances indicated in point 4, the Hostel will return all received payments in the time of 7 working days since the day of posting them into the bank account of the Hostel.
  6. Lack of the above-mentioned written confirmation or lack of the confirmation of the validity of a credit card results in the lack of the guarantee as for the quantity of sleeping accommodation, length and price of the stay. The responsibility of the Hostel is excluded.
  7. For cash deposits or down payments by draft making from the branches of banks and institutions having registered office in the area of the Republic of Poland, the moment of reading out by the Hostel the message with the copy of confirmation of the down payment is regarded as the moment of receiving the payment. The copy of confirmation of payment can be sent via e-mail or fax, by letter, or it can be provided to the reception personally.
  8. For cash deposits or down payments by draft making from the branches of banks and institutions having registered office outside the area of the Republic of Poland, the moment of posting the down payment to the bank account of the Hostel is regarded as the moment of payment.
  9. Provisional booking or reply to the inquiry do not constitute the offer in understanding adequate rules of the civil code.
  10. Written confirmation of a reservation constitutes the offer in understanding adequate rules of the civil code.
  11. Written confirmation of a reservation means approval of booking conditions, which are determined in this Regulations, by a person making a reservation for oneself or on behalf or in aid of other persons in case of a group reservation.
  12. The Hostel can make pre-authorisation both of a credit card and registration of the transaction towards the payments for the stay within a written confirmed reservation.
  13. All payments for ordered services of the Hostel are being taken at the latest in the moment of registering the Guest.
  14. Making the room/place available for the Guest can occur exclusively after paying the whole of the stay and paying down for the key.

IV. BOOKING CANCELLATION AND ALTERATION

Cancellations and alterations making by the Guests:

  1. Cancellation or alteration of the whole or a part of reservation, which is secured with the data of a credit card, are possible without calculating costs provided that the Guest will report this fact earlier than 48 hours (2 entire days) before the date of planned arrival. For beginning of the day of planned arrival it is assumed the 00:00 of the Central European Time (Warsaw Time).
  2. Cancellation or alteration of the whole or a part of reservation, which is secured with the down payment (including non-returnable reservation), are not possible. Non-appearance of the Guest and any alterations and cancellation of the whole or a part of such a reservation result in burdening the Guest with payments up to the amount paid towards a reservation.
  3. Cancellation of a provisional booking without any costs can be made by the Guest at any moment. The Guest is not obliged in any way to inform the Hostel about backing out of a reservation.
  4. In case of not reporting by the Guest earlier than 48 hours before the planned arrival the cancellation or alteration of the booking, which is secured with the data of a credit card, the Hostel will burden the Guest with the payment up to the 100% of the value of the entire booking for the late cancellation or alteration of the entire reservation.
  5. In case of non-arrival of the Guest on account of the booking secured with the data of a credit card, the Hostel will burden the Guest with the payment up to the 100% of the value of the entire booking for non-arrival of the Guest.
  6. In case of not reporting by the Guest earlier than 48 hours before the date of planned arrival the cancellation or alteration of the booking, which is secured with the advance payment, the Hostel will burden the Guest with the payment up to the amount of payment for the late cancellation or alteration.
  7. In case of non-arrival the Guest, on account of the booking secured with the down payment the Hostel will burden the Guest for the non-appearance of the Guest with the payment of the amount paid.
  8. In case of reservations confirmed in writing and lack of the earlier agreement with the reception – non-arrival the Guest up to 6 am the day following the calendar day of planned arrival is tantamount to resignation from the stay and it is treated as non-appearance of the Guest. In such a case the reservation is cancelled. Possible later appearance of the Guest will be connected with necessity for a new reservation.

Cancellations and alterations made by the Hostel:

  1. Cancellation of a provisional booking can be made by the Hostel without any costs at any moment. In case of the cancellation of a provisional booking by the Hostel, the information about this fact will be passed on to the Guests provided they left important and correct contact data when making a reservation.
  2. In case of the cancellation of a reservation that is guaranteed with down payment or in case of lack the possibility of assurance the places in spite of earlier written confirmation of such a reservation the Hostel is obliged to assure the places in the ordered amount and the date in a similar class property and within the ordered price. In case of lack such a possibility the Hostel is obliged to return paid amounts twice higher, in proportion to the number of missing spots.
  3. In case of cancellation of a reservation that is guaranteed with a credit card or in case of lack a possibility of assurance places in spite of earlier written confirmation of such a reservation the Hostel is obliged to assure the missing number of places in the ordered amount and the date in a similar class property and within the ordered price.
  4. The principles discussed in points 1-3 has no use in case of lack a possibility of assurance the accommodation by the Hostel for the reasons independent of the Hostel, in particular: because of force majeure, breakdown, lack of possibility to continue business activity, threat for life or health, war, external factors. In this case all payments taken by the Hostel will be returned.

V. ADDITIONAL INFORMATION

  1. Persons who apply for an entry visa to Poland should report to the Hostel reception the need of getting a letter confirming a reservation to the embassy. Such a letter will be drawn up and sent to the given e-mail address no later than within 48 hours since payment the amount due for a booked stay. The amount due is not subject to a refund in case of booking cancellation or alteration.
  2. The Regulations constitute a commitment of the Parties as for their contents. A Guest consents to approval both of the Regulations in full and the price list that is placed on the web page www.lagitarra.com. as well as to calculate payments, which are pointed there, without the additional statement.
  3. Hereby I am giving my consent to processing my personal details in accordance with the requirements of the 29.08.1997. Data Protection Act (2002 journal of Laws, No. 101, pos. 926 as amended) with the aims connected with making reservations via the web page www.lagitarra.com or in another way as well as with the aims of archiving to needs of the Hostel. I am declaring that I was informed that giving my data is voluntary as well as that I have the right to access to the contents of my data and the opportunity to correct them or delete.
