RULES OF STAY AT LA GUITARRA HOSTELS

I. DEFINITIONS.

1. Mixed Dorm – a bed/place in a coed multi-person room. Additional places in this room may be occupied as reservations arrive in accordance with the reception's instructions regarding the distribution of guests in the rooms. In this type of room, guests can count on the possibility of sharing a room with other, unknown people of both sexes. One reserved bed in this type of room is intended for one person only.
2. Private Room – a private room rented in its entirety by one or more people.
3. Preliminary reservation – reservation without any guarantee from the Hostel as to price, number and type of places/rooms and length of stay.
4. Confirmed (guaranteed) reservation – a reservation confirmed in writing or in the form of another document (e.g. fax, e-mail, text message) guaranteed by a deposit payment or credit card details. The guarantee applies to the price of the stay, length of stay, number and type of places or rooms.
5. Group booking – booking of at least 10 places for the same date by one entity/person.
6. Individual reservation – a reservation made by an individual for less than 10 places for the same date.
7. Non-refundable reservation (non-refundable, guaranteed) – a reservation confirmed in writing or in documentary form, in the case of this reservation, the entire fee for the stay is charged on the day of its making and is non-refundable.
8. Deposit/Prepayment – non-refundable payment towards a guaranteed reservation.
9. Credit card – credit card details provided by the Guest to secure all fees related to the stay.
10. Confirmation of booking – a written or documentary statement by the Hostel, issued after the advance payment, sending of credit card details or, in the case of group bookings, after other actual confirmation of the commitment (order) made by the Guests.
11. Reservation inquiry – inquiry regarding the possibility of booking accommodation at the Hostel.
12. The e-mail address provided by the person or the Hostel is the binding address for submitting declarations of intent regarding the reservation.
13. Reservations can also be made at the Hostel reception.

II. GUEST SERVICE RULES.

1. The Hostel reception is open 24 hours a day.
2. Beds in rooms or entire rooms are rented for hostel days.
3. The hostel day starts on the day of rent at 2:00 p.m. Guests are expected at any time. The room or bed will be made available to guests as early as possible, taking into account that they require prior preparation, and guests occupying them on the previous day should check out.
4. Check-out – the hostel day ends at 11:00. By that time, the room (space) should be vacated and the key returned to the Hostel reception. Failure to check out by 11:00 will result in a fee for another started day, but does not guarantee an extension of stay.
5. If the room or bed is not vacated by 11:00, and the room or bed is booked for the next day by another Guest, the Hostel staff is entitled to enter the room without the Guest's presence, pack his/her belongings and move them to the luggage storage.
6. A Hostel Guest should report a wish to extend their stay at the reception desk by 6:00 p.m. on the day preceding the expiry of their stay.
7. The hostel will consider requests to extend your stay as long as there are places available. A request to extend your stay does not guarantee that your reservation will be confirmed.
8. Beds and rooms are rented to specific Guests, each of whom may be asked to show an ID upon check-in.
9. It is unacceptable and contrary to the Regulations to lend or transfer rooms or beds in rooms to other persons or Guests, even if the period for which the Guest paid the fee for the stay has not expired.
10. Only registered guests or minor children under their care are allowed to stay on the premises.
11. People who are not registered at the Hostel may stay on the premises from 2:00 p.m. to 10:00 p.m. only with the consent and knowledge of the Hostel staff. Outsiders are not allowed to stay outside these hours.
12. Night time silence is in effect from 11:00 p.m. to 6:00 a.m. During night time silence, persons using the Hostel’s services are obliged to behave in a way that does not disturb the peace of other Guests and residents of the Hostel and neighbouring properties.
13. A guest leaving the room should check if the door is closed and leave the key at the reception. In case of loss of the key, a fee is charged according to the price list available on the website www.lagitarra.com.
14. During longer stays, rooms are cleaned after the third hostel day. Bed linen is changed after the seventh hostel day.
15. The Hostel provides all Guests with so-called common areas. Please keep these places tidy and clean. Areas such as the reception hall, dining room, kitchen, common room, computer stations are closed during quiet hours (11:00 p.m. - 6:00 a.m.).
16. Smoking is prohibited throughout the entire facility. Smoking is only permitted in designated areas. Persons or Guests who do not comply with this ban will be charged a fee according to the price list available on the website www.lagitarra.com. This fee covers the costs of, in particular: washing curtains, drapes, bedspreads, carpets, bedding and other textiles in the room where the smoking ban was broken. The smoking ban applies to smoking tobacco, its substitutes (e-cigarettes), as well as other stimulants.
17. Due to fire safety, it is prohibited to use in rooms in particular: heaters, electric irons and other similar devices that are not part of the hostel room equipment. This does not apply to chargers and power supplies for RTV and computer devices.
18. It is not allowed to move room equipment without the consent of the reception.
19. The Hostel may refuse accommodation or evict during the stay a Guest whose behavior could violate or has violated the Hostel Regulations or otherwise violated the rules of social coexistence. In such a case, the payment for the stay is not refundable.
20. The Guest bears full financial responsibility for any damage or destruction of objects, equipment and technical devices caused by his or her fault or the fault of people visiting him or her. In the event of the above circumstances, the Hostel has the right to charge the Guest for the destruction or damage referred to in this point. In the case of a group booking, the responsibility of the persons covered by the booking is joint and several.
21. The hostel is under the care of a security agency 24 hours a day.
22. The common areas of the Hostel are monitored 24 hours a day.
23. The Hostel's liability for loss or damage, in particular to money, securities, valuables or items of scientific or artistic value is limited if these items are not deposited at the reception desk. The rooms are not intended for storing the above items.
24. Guests will be charged for any damage caused after it has been assessed by the facility's reception. Guests should notify the person at the reception immediately after it is discovered.
25. The Hostel is not responsible for any damage or loss of a car or other vehicle belonging to the Guest.
26. Personal belongings left by a departing Guest may, at their request, be sent to the address indicated by the Guest and at their expense. If such an instruction is not received, the Hostel will store these items for 30 days. After this period, they will be removed.
27. Keys are collected from the Hostel reception after paying a cash deposit. The amount of the cash deposit is specified in the price list available on the website www.lagitarra.com. This deposit is returned upon check-out when the Guest returns the undamaged key. In the event of loss or destruction of the key, a fee is charged according to the price list available on the website www.lagitarra.com.
28. Each registered Guest is obliged to collect the key.
29. As part of the procedures for securing the facility against unauthorized or unwanted persons, the Hostel Reception may prohibit entry to the Hostel premises or remove from the facility a person who does not have a key.
30. In case of noticing damage or failure of equipment, facilities or facility, the Guest should immediately notify the Hostel reception about this fact. This will allow the staff to react immediately.
31. In the event of noticing a situation that may pose a risk to the life, health, peace, quiet at night or loss of property of the Hostel residents, the Guest should immediately notify the Hostel reception about this fact. This will allow the staff to react immediately.
32. Guests sleeping in the Hostel on beds without covered bedding will be charged a fee according to the price list available on the website www.lagitarra.com - reflecting the costs of disinfecting the duvet, pillow and mattress.
33. Guests using more beds than rented and paid for will be charged the amount resulting from the actual number of beds used.
34. Guests who bring other people onto the Hostel premises who are not registered Guests of the Hostel without the consent of the reception desk will be charged a fee according to the price list available on the website www.lagitarra.com.
35. Sharing the entry card with third parties due to the safety of property and health of other people may result in the cancellation of the reservation or interruption of the stay and a fee in accordance with the provisions of point 34 of these Regulations.
36. Situations that pose a threat to the life, health and peace of the Hostel's residents may be the reason for the Hostel to cancel the reservation or to interrupt the stay at the Hostel's request.
37. It is strictly forbidden to eat meals in the rooms of the Hostel – eating meals and drinking beverages is allowed in the common room in the dining and lounge areas.
38. All food and drinks will be removed from the rooms by the Hostel staff.
39. There is a total ban on the consumption of alcoholic beverages and taking narcotic substances throughout the facility.
40. All additional fees related to the Guest's stay are specified in the price list available on the website www.lagitarra.com, which the Guest accepts in its entirety.
41. All fees resulting from the stay fees, including the fees listed in points 16, 24, 40 of these regulations, may be collected by the Hostel without the Guest's presence under the Credit Card Guarantee.
42. In the case of group reservations, the terms and conditions of the order confirmed in writing or in documentary form are considered binding unless they state otherwise than these Regulations.
43. If one person makes one or more reservations for a total number of more than 10 places for the same date, the Hostel may treat it as a group reservation. In such a case, the Hostel reserves the right to refuse to confirm the reservation.
44. In the case of group reservations, the terms of the order confirmed in writing or in documentary form are considered binding if they state otherwise than these Regulations. Consent in writing or in documentary form is expressed in particular via e-mail.

III. BOOKING AND PAYMENT RULES

1. Reservations can be made:

  • automatically – using online booking systems
  • in a traditional way – by contacting the reception: by e-mail, via instant messengers, in person at the hostel reception, by telephone and fax.

2. The reservation is considered guaranteed as to the price, length of stay and number of rooms/places ordered after confirmation of this fact by the Hostel in writing or in documentary form.
3. The Hostel confirms the reservation in writing or in documentary form after receiving the deposit payment or after receiving the details of a valid credit card, provided, however, that the relevant provisions of the Civil Code applicable to the deposit may only be applied after sending the above-mentioned confirmation and not from the moment of payment.
4. The hostel reserves the right to refuse to confirm a reservation despite the payment of a deposit or the provision of valid credit card details.
5. If the circumstances indicated in point 4 occur, the Hostel will return all payments received within 7 working days from the date they are credited to the Hostel's bank account.
6. Lack of confirmation in writing or in the form of a document as mentioned above or lack of confirmation of the validity of credit card details - results in no guarantee as to the number of beds, length of stay and price. The Hostel's liability is excluded
7. For cash and bank transfer deposit payments from bank branches and institutions based in the Republic of Poland, the moment of receipt of the payment is considered to be the moment the Hostel reads the message with a copy of the confirmation of the deposit payment received via e-mail, fax, letter or in person at the Hostel reception.
8. For cash and bank transfer deposits from banks and institutions based outside the territory of the Republic of Poland, the moment of payment is considered to be the date on which the payment is credited to the Hostel's bank account.
9. A preliminary reservation or a response to an inquiry does not constitute an offer within the meaning of the relevant provisions of the Civil Code.
10. Confirmation of the reservation in writing or in the form of a document constitutes an offer within the meaning of the relevant provisions of the Civil Code.
11. Confirmation of the reservation in writing or in documentary form means acceptance of the reservation conditions specified in these Regulations by the person making the reservation or on behalf of and for the benefit of persons in the case of a group reservation.
12. For fees related to the stay as part of a reservation confirmed in writing or in documentary form, the Hostel may pre-authorize the credit card and register the transaction.
13. All fees for ordered Hostel services are collected at the latest upon check-in of the Guest.
14. The room/space may only be made available after payment of the entire stay and payment of a deposit for the key.

IV. CANCELLATION AND CHANGES TO RESERVATIONS

Cancellations and changes made by Guests:

1. Free cancellation or change of all or part of a reservation secured by credit card data is possible provided that the Guest reports this fact no later than 48 hours (2 full days) before the planned arrival date. The planned arrival day is considered to start at 00:00 Central European Time (Warsaw Time).
2. Free cancellation or change of all or part of a reservation secured by a deposit (including non-refundable reservations) is not possible. No-shows and any changes and cancellation of all or part of such a reservation will be charged to the Guest up to the amount paid for the reservation.
3. The Guest may cancel the provisional reservation free of charge at any time. He/she is not obliged to inform the Hostel in any way about the withdrawal from such reservation.
4. If the Guest does not notify about the cancellation or change of the reservation secured by credit card details earlier than 48 hours before the planned day of arrival, the Hostel will charge the Guest a late cancellation or change fee of 100% of the value of the entire reservation.
5. In the event of a no-show for a booking secured by a credit card, the Hostel will charge the Guest a no-show fee of PLN 100% of the entire booking value.
6. If the Guest does not notify about the cancellation or change of the reservation secured by prepayment earlier than 48 hours before the planned day of arrival, the Hostel will charge the Guest a fee for late cancellation or change of reservation in the amount of the payment made.
7. In the event of a no-show for a reservation secured by a deposit, the Hostel will charge the Guest a no-show fee in the amount of the deposit made.
8. In the case of reservations confirmed in writing or in documentary form - failure of the Guest to appear at the Hostel by 6:00 a.m. on the day following the planned calendar day of arrival is equivalent to resignation from the stay and is treated as a no-show. In such a case, the reservation is canceled, and any later appearance of the Guest will be associated with the need for a new reservation.

Cancellations and changes made by the Hostel:

1. Free cancellation of a provisional booking can be made by the Hostel at any time. In the event of cancellation of a provisional booking by the Hostel, information about this fact will be provided to Guests, provided that they leave valid and correct contact details when making the booking.
2. In the event that the Hostel cancels a reservation guaranteed by a deposit payment or if it is impossible to secure places, despite prior confirmation of such a reservation in writing or in documentary form, the Hostel undertakes to secure the missing accommodation places in the ordered number and on the ordered date, in a facility of a similar class, within the ordered price, and in the event that it is impossible, to return the amounts paid for the reservation in double their amount in proportion to the number of missing places.
3. In the event that the Hostel cancels a reservation guaranteed by a credit card or if it is impossible to secure places despite prior confirmation of such a reservation in writing or in documentary form, the Hostel undertakes to secure the missing accommodation places in the ordered number and on the date in a facility of a similar class within the ordered price.
4. The rules described in points 1-3 do not apply if the Hostel is unable to provide accommodation for reasons beyond its control, in particular: force majeure, failure, inability to continue operations, threat to life or health, war, external factors. In this case, all payments accepted by the Hostel will be returned.
5. The Hostel may also cancel a reservation if the Guests do not make timely payments, or if the Guests do not fulfill other obligations related to the reservation, or if the Guests are removed from the facility for reasons related to a violation of these regulations. In the event of such a cancellation, any payments made earlier are not refundable. The Hostel also has the right to seek additional compensation if the damage resulting from such a reservation/cancellation exceeds the value of the amounts paid so far.

V. ADDITIONAL INFORMATION

1. People applying for an entry visa to Poland should report to the Hostel reception the need to obtain a letter to the embassy confirming the reservation. Such a letter will be prepared and sent to the provided email address no later than 48 hours after the full payment for the booked stay. This payment is non-refundable in the event of cancellation or change of the reservation.
2. The Regulations constitute the obligation of the Parties as to their content. The Guest agrees to accept the Regulations in their entirety and the price list placed on the website: www.lagitarra.com. and to charge the fees indicated therein without additional declaration.
3. I hereby consent to the processing of my personal data in accordance with the requirements of the Act of 29 August 1997 on the Protection of Personal Data (Journal of Laws of 2002, No. 101, item 926, as amended) for purposes related to making reservations via the website www.lagitarra.com or otherwise and for archival purposes for the Hostel. I declare that I have been informed that providing my personal data is voluntary and that I have the right to access the content of my data and the possibility of correcting or deleting it.
